On July 26, 2016, the Chair of the Central Election Commission rejected ISFED’s complaint over violation of campaigning rules by the Georgian Dream – Healthy Future, and terminated administrative proceedings.

Coalition for an Independent and Transparent Judiciary considers it important to reassess the judicial selection competition and react to the judicial selection meeting that will take place at High Council of Justice today. It is well known that Coalition has been criticizing the competition, which was held without following minimal procedural guarantees established in the legislation. The ongoing competition as well as previous ones did not show that Council’s approach to the implementation of its constitutional duty was based on the sense of responsibility and integrity. Council did not use all possible methods to appoint judges based on merit. Numerous flaws revealed during the ongoing competition raise questions regarding adequacy of the selection process and undermine its results. This deepens public’s disappointment in the court system.

Today, legal representatives of Rustavi 2 have appealed the decree of Tbilisi Court of Appeal to the Supreme Court of Georgia. As a result of the hearing in the court of second instance, the decision of the Tbilisi City Court stating the ownership of 100% shares of the company by Kibar Kalvashi remained unaffected.

International Society for Fair Elections and Democracy (ISFED) has filed applications with the State Audit Office (SAO) and the Central Elections Commission (CEC), demanding that SAO launch a probe into a possible vote buying by the Georgian Dream for Democratic Georgia and a non-profit legal entity “Georgian Dream – Healthy Future”, and the CEC to investigate possible illegal participation of the Georgian Dream – Healthy Future in election campaign (canvassing).

The Coalition for an Independent and Transparent Judiciary assesses the judicial selection competition announced by High Council of Justice to fill 65 vacant positions.  By now the interviews of all candidates have been completed. The Council’s decision with respect to selected candidates will be publicized later.

The Parliament of Georgia is fast-tracking government-initiated draft amendments to the Criminal Procedure Code. The objective of the amendments is to address the deficiencies detected in practice and to bring the legislation in line with international standards.

The Coalition for an Independent and Transparent Judiciary believes that the defendant’s right to privacy was violated in the process of hearing Magda Papidze’s case in court. The Prosecution’s violation of the right to privacy was especially harsh. Additionally, the court hearings were conducted with numerous procedural violations. All of the above may adversely affect the fair hearing of the case.
